In a significant development regarding a controversial compensation initiative, a federal judge has mandated that the Trump administration disclose details about the architects behind a proposed $1.8 billion fund. This fund was intended to compensate individuals claiming victimization due to political prosecution. U.S. Magistrate Judge Ivan Davis issued this order within the context of a lawsuit challenging the fund’s legitimacy. The lawsuit was filed by Democracy Forward representing several plaintiffs, including a former federal prosecutor and a college professor, both of whom faced charges related to protesting an immigration raid but were later acquitted.
Despite the Justice Department’s announcement last month that the fund proposal had been scrapped, the origins of this initiative have drawn scrutiny. Former Justice Department official Todd Blanche confirmed that the fund had never been operational, describing it as effectively defunct. The proposed fund was initially part of a settlement involving former President Donald Trump and the Internal Revenue Service (IRS). Critics voiced concerns that the fund might have compensated individuals prosecuted in connection with the January 6, 2021, Capitol riot, among other contentious cases.
The fund proposal faced bipartisan opposition, including resistance from Republican senators. Questions arose regarding the potential revival of the program, despite its supposed abandonment by the administration. In a related ruling from July, a federal judge determined that Trump’s lawsuit against the IRS, which led to the settlement forming the fund’s framework, lacked a legitimate legal dispute and appeared to have been used to facilitate the creation of the fund.
Former President Trump has expressed his disappointment over the decision to discontinue the program, asserting that certain individuals were treated unfairly and could have benefitted from compensation. The recent court order could shed light on the fund’s establishment process and explore the possibility of pursuing compensation through alternative mechanisms.
